It was great to discuss important topics and get to know our members better.<\/p>\n<p>CNFA originally planned for the conference to be in lieu of this newsletter, but we have some exciting updates that couldn&#8217;t wait.<\/p>\n<h2><strong>Announcements<\/strong><\/h2>\n<p><strong>Consumer fireworks are\u00a0no longer regulated by the Province of <\/strong><strong>Alberta<\/strong><\/p>\n<p>The CNFA&#8217;s hard work has officially\u00a0paid off and we are proud to announce that changes have been made to the Alberta Fire Code (AFC) relating to consumer fireworks! As of April 1st, 2019, the Province of Alberta has announced that the AFC will be replaced with the National Fire Code- Alberta 2010 Edition and it will no longer regulate consumer fireworks. Essentially, a municipality now has the option to\u00a0enact a fireworks bylaw, or leave fireworks to be regulated by\u00a0the\u00a0<em>Federal\u00a0Explosives Act<\/em>.\u00a0This is a BIG win for the Association and for our members! These efforts have been in the making for several years and the CNFA is proud of this success.\u00a0Here are the changes that have been made to the AFC:<\/p>\n<p>Fireworks, including low hazard fireworks (sometimes referred to as consumer or family fireworks), are regulated by the federal<em>\u00a0Explosives Act<\/em>\u00a0(Canada E-17). The Act deals with the manufacture, import, sale, and use of all fireworks and pyrotechnical devices using explosives. The current AFC 2014 edition and previous fire codes included additional provisions that varied from federal regulation. Following engagement sessions with stakeholders by Municipal Affairs in November 2016, there was broad support for making fireworks rules consistent with federal legislation and allowing local authorities to manage the use of fireworks in their communities.<\/p>\n<p>Under the updated fire code adopted in Alberta, entitled the\u00a0<em>National Fire Code- 2019 Alberta Edition<\/em>, rules for fireworks are made consistent with the\u00a0<em>Explosives Act\u00a0<\/em>and municipalities will as a result have additional flexibility to regulate fireworks.<\/p>\n<p>The following bulletins on fireworks are no longer in effect under the updated fire code:<\/p>\n<ul>\n<li>FCI\u201310-01 Low Hazard Fireworks \u2013 Permits, Storage and Display<\/li>\n<li>FCI\u201310-02 Low Hazard Fireworks \u2013 Enforcement<\/li>\n<\/ul>\n<h2><strong>Code Changes for Fireworks<\/strong><\/h2>\n<p>Under Section 5.7. and subsection 3.2.10. of the AFC 2014, references to fireworks have been replaced with the following references under the updated\u00a0<em>National Fire Code &#8211; 2019 Alberta Edition<\/em>:<\/p>\n<table>\n<tbody>\n<tr>\n<td width=\"638\"><strong>5.1.1.2.\u00a0Explosives<\/strong><\/p>\n<p>1)\u00a0\u00a0 The manufacturing, handling, transportation, sale and use of\u00a0<em>dangerous goods<\/em>\u00a0classified as explosives shall be in conformance with\u00a0NRCan\u00a0R.S.C., 1985, c. E-17, \u201cExplosives Act,\u201d and its Regulations.<\/p>\n<p><strong>5.1.1.3.\u00a0Display Fireworks<\/strong><\/p>\n<p>1)\u00a0\u00a0 The handling and discharge of fireworks shall conform to\u00a0NRCan\u00a02010, \u201cDisplay Fireworks Manual.\u201d<\/p>\n<p><strong>5.1.1.4. Prohibited<\/strong><\/p>\n<p>1)\u00a0\u00a0 No person shall have in his possession, sell, offer for sale, give away or otherwise distribute, discharge, fire or set off\u00a0<em>firecrackers<\/em>.<\/p>\n<p>2)\u00a0\u00a0 No person shall purchase, store, use or supervise the use of a pyrotechnic device unless,<\/p>\n<p>a)\u00a0\u00a0 the pyrotechnic device conforms to the requirements of NRCan R.S.C., 1985, c. E-17, \u201cExplosives Act\u201d and its Regulations and<\/p>\n<p>b)\u00a0\u00a0 the person is certified in accordance with NRCan R.S.C., 1985, c. E-17, \u201cExplosives Act\u201d and its Regulations.<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p>Under the\u00a0<em>Explosives Act<\/em>\u00a0and Regulations, there are three classifications of fireworks:<\/p>\n<ul>\n<li><strong>Consumer fireworks\u00a0<\/strong>are low-hazard and designed for recreational use. They include items like Roman candles, sparklers, fountains, volcanoes, mines, and snakes.\u00a0 Classified as F.1.<\/li>\n<li><strong>Display fireworks\u00a0<\/strong>are high-hazard and designed for professional use. They include items like aerial shells, cakes, Roman candles, waterfalls, lances, and wheels.\u00a0 Classified as F.2.<\/li>\n<li><strong>Special effect pyrotechnics<\/strong>are high-hazard and designed for professional use. The CNFA worked to stop it. We engaged with residents and learned that the majority wanted the ability to celebrate with consumer fireworks. Our efforts helped City Council arrive at the decision to vote against the proposed bylaw. The CNFA recently received the following by email from the ERD:<\/p>\n<p><strong><em>&#8220;The proposal to increase limit for unlicensed storage of fireworks is planned to be included with our amendment #4 package.\u00a0 Our schedule is to finalize all policies for amendment #4 by the end of the year.\u00a0 The package will then go through the approvals process and we are <\/em><\/strong><strong><em>looking at\u00a0Canada Gazette, Part I sometimes early next year. &#8220;<\/em><\/strong><\/p>\n<p>If you have questions on how this effects you as a retailer, <a href=\"mailto:info@c-nfa.org?subject=Re%3A%202000%20kg%20storage%20limit%20increase\">please reach out to us<\/a> for more information.<\/p>\n<h2>Recent and Upcoming Events<\/h2>\n<p><strong>Annual CNFA Conference, April 2019<\/strong><\/p>\n<p>CNFA member participants heard presentations from our government relations team, our Acting Executive Director, Melanie Sutherland, our technical consultants and from the ERD.
